Intellectual Property Rights

1. I retain rights as the creator of the artwork.

 

In other words, the client may not claim that they drew or designed the commissioned artwork or art adopt.

​

The client may also not use my art as a base, edit, or trace over it without my permission.

​

​

PERSONAL USE TERMS:

 

You may use commissioned artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays.

​

You reserve the right to print or create an otherwise physical reproduction of the artwork as long as it is for your PERSONAL use only (ie. NOT for sale).

 

You may not use the Artwork for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc.) unless otherwise discussed.

Redistribution of my artwork in the form of printed merchandise as a means of promoting goods, services, or social media pages is prohibited unless you have paid the additional commercial-use fee.

COMMERCIAL USE TERMS:

​

Fanart Policy: I will not draw fanart for commercial use unless if the client is associated with the subject matter. For example, I will not draw fanart of a character for the client to sell as prints UNLESS if the client is affiliated with the character in any way—such as being the voice actor of the character—and if selling fanart does not break the franchise's ToS. I will also not draw any leaked content for legal reasons.

*Purchase of commercial-use does not include prints or physical goods. In other words, I am providing you the artwork, not the merch itself

The following cases are considered commercial use: Reproducing and selling the artwork, publicly or privately, cases where you receive profit from a medium/platform where you have posted my artwork, (eg. Patreon, YouTube, Twitch, a personal site, business cards etc).

For art designs/art adopts: You may resell your art adopt/designs at the same price that you bought it from me for. If you have commissioned additional art for your adopt, feel free to adjust the price accordingly when reselling the design. Please let me know who the new owner of the adopt is to avoid any future misunderstandings.

3. Conditions for Reposting: 

 

The client may repost my artwork anywhere as long as my watermark/signature remains intact and unaltered alongside with proper credit is given (please link to my Twitter or VGen profile in the description of the post).

​

Please only upload the smaller file publicly unless otherwise discussed.

​

You may not upload or host my work in any gallery that is intended to display your own work only.

​

You are responsible for protecting your ownership over rights to a character design made by me by creating a copy image with your name added as well (ie. through a watermark) when uploading on external sites.

 

​​The artist may post the finished artwork as well.

​​

​

4. Prohibited Actions & Keep in mind…

 

• The client may not alter my artwork in any way without asking for permission beforehand with the exception of cropping and resizing the image.

 

• I am only offering my art services when you commission me. Please be a decent human being and do not hang in my inbox if you plan to demand my personal attention and send inappropriate content daily.

 

• Please don’t ask me for an update every single day or every couple hours.

 

• Understand that outside of your commission, I do have a life and may need tiny doodle breaks from time to time.

 

• Time zone differences may be why I am not able to answer your messages right away at times. Keep in mind that I might actually be sleeping or eating food so please don’t panic.

Payment

​​

​

1. I accept payment in USD $. I will use PayPal Invoices or accept payment through VGen.

​

​

* Upfront full payment before I start working on your commission

The handling fee of the respective site will be added onto the final price of your commission

Paypal: 4.4%

VGen: 5.0%

​

2. Non-payment within 48 hours after I have ask for payment and notify you that I will soon be ready to work on your commission will result in the commission being canceled.

​

​

3. The product being paid for is digital artwork, not physical prints.

​

​

4. Upon payment, you are agreeing that you are the cardholder of the card that is linked to the bank account used.

 

If by any chance I receive a chargeback because the cardholder did not make the purchase, I take no responsibility over it since it is not my job to confirm that you are the authorized cardholder or not (e.g. a parent carelessly letting their child use their PayPal or credit/debit card).

5. Upon payment for a NSFW artwork, you are agreeing that you are 18+ years old.

​

Please send me proof of age such as an ID.

​

​

6. It is the commissioner’s responsibility to notify when the payment has been sent.

 

This is to ensure that the transaction has been seen on both ends. It also lets me know for sure that you paid for your commission. If you fail to tell me that payment has been sent within 48 hours, then the 48-hour payment term will be applied.

7. NO REFUNDS

​​

• The artist reserves the right to cancel a commission for any reason and at any time without explanation. The only cases I can see myself canceling a commission is if I didn't start working on one and an emergency comes up. I always make sure to maintain communication about my situation so there should not be many problems.
